StockFirst terms of service

These terms are the agreement between you and Subtle Marketing for the use of the StockFirst app for Shopify. Read them before you install the app.
Summary
- StockFirst moves sold-out products to the bottom of the collections you choose.
- To do this, the app switches each sorted collection to manual order in Shopify and changes the position of products in it.
- You can restore the earlier order. Do this before you uninstall, because the app cannot change your store after the uninstall.
- Shopify bills you for paid plans. Every paid plan starts with a 14-day free trial.
- We do not promise that the app is always available or free of errors.

In these terms, "we" means Subtle Marketing. "You" means the person or company that owns the Shopify store. "The app" means StockFirst.
You accept these terms when you install the app. If you install the app for a company, you confirm that you are allowed to accept these terms for that company.
Your use of Shopify is covered by your own agreement with Shopify. These terms do not change that agreement.
What the app does
The app sorts the products in the collections that you choose.
- Sold-out products move to the bottom of the collection.
- The other products stay in the base order you chose: the current order, best selling, newest, price, title or most stock.
- When a product is back in stock, it returns to its previous position. On paid plans you can choose another option.
- The app sorts on a schedule and when you press Sort now. On paid plans it also sorts when stock changes.
- After a sort, the app reads the public page of the collection in your online store to check that the page shows the new order.
- The Activity page lists the sorts of the last 90 days.
You decide what counts as sold out. The rules are on the Settings page and on the Help page of the app.
What the app changes in your store
The app changes 2 things in your store, and only for collections where you turned sorting on.

The app does not change your products, prices, stock numbers or theme. It does not hide products. Sold-out products stay visible at the bottom of the collection.
The app changes nothing until you turn sorting on for a collection. You can see a preview of the new order first.
You are responsible for the collections you choose and for the settings you make. Check the preview and the result of the first sort.
How to restore an earlier order

Limits of the restore:
- The Activity page keeps sorts for 90 days. You cannot restore a sort that is older.
- If the collection used an automatic sort setting before, for example best selling, "Restore original order" brings back that setting. Shopify then sets the order.
- If the collection used manual order before, "Restore original order" brings back the saved order. Products that you added to the collection later are placed at the end. Products that you removed are left out.
- A restore can fail, for example when Shopify does not answer. The app then shows a message and you can try again.
- After you uninstall the app, it cannot restore anything. Your collections stay in the order of the last sort. To go back to your original order, use "Restore original order" before you uninstall.
Your storefront can show a different order
Your theme or another app can set its own order for a collection page. Shoppers can also pick a sort order themselves if your theme offers this. In these cases the storefront does not show the order the app set. The app warns you when it finds this, and the Help page explains how to fix it. We cannot change your theme or other apps.

Prices are in US dollars. Taxes can be added.
A feature marked "Coming soon" in the app is not part of your plan until we release it.
Free trial
Every paid plan starts with a 14-day free trial. Shopify does not charge you for the plan during the trial. Shopify runs the trial and its billing rules apply.
Billing
- Shopify bills you. The charges for the app appear on your Shopify bill.
- You choose, change and cancel your plan on Shopify's page. The Plans page of the app links to it.
- We never see or store your payment details.
- Shopify's billing rules apply to charges, billing dates and refunds.
Changing your plan
You can move to a larger or a smaller plan at any time. If you move to a smaller plan, the app keeps your rules. If more collections are sorted than the new plan allows, the app turns sorting off for the collections you turned on last. They keep their current order, and you can choose which collections stay sorted. Features that are not in the new plan go back to their standard setting.
Price changes
We can change the plans and prices. We tell you before a new price applies to your store.
Rules for using the app
You agree to:
- use the app only for a store that you own or are allowed to manage
- use the app only through the Shopify admin
- follow the law and Shopify's terms
You agree not to:
- copy, resell or rent the app
- try to read the code of the app or to get around the limits of your plan
- disturb the app or its server, for example with automatic requests
- use the app to harm another person, store or service
Support
We give support by email at support@subtle-marketing.com. We aim to reply within 1 working day. Include the address of your store in your message.
Availability
We work to keep the app running, but we do not promise that it is always available. We give no uptime guarantee.
- The app depends on Shopify, on our hosting provider and on our email provider. If one of them has a problem, a sort or an email can be late or can fail.
- A sort can be late or can fail for other reasons too. The app records a failed sort on the Activity page. It also sends you an email if you turned this email on.
- We can stop the app for a short time for maintenance or updates.
- We can change or remove features. If we remove a feature that you pay for, we tell you before.
Your data
Our privacy policy explains what data the app stores and when it is deleted. The app does not read your customers or your orders.
Ownership
The app, its name and its design belong to us. These terms give you the right to use the app for your store while the app is installed. They give you no other right to the app.
Your store and its data belong to you.
No warranty
We provide the app "as is". As far as the law allows, we give no warranty that the app is free of errors, that it fits a special purpose, or that a sort always gives the result you expect.
Limits of our liability
As far as the law allows:
- We are not liable for lost sales, lost profit, lost data or other indirect loss that follows from the use of the app, from a wrong or late sort, or from a time when the app was not available.
- Our total liability to you is limited to the amount you paid for the app in the 12 months before the event that caused the loss. If you use the Free plan, the limit is 50 US dollars.
These limits do not apply where the law does not allow them, for example for damage we cause on purpose.
Ending the agreement
You
You can stop at any time. Uninstall the app in your Shopify admin.
- Your collections stay in the order of the last sort and stay in manual order.
- Shopify stops the charges for the app according to its billing rules.
- The app deletes your data as described in the privacy policy.
We
We can stop or limit your use of the app if you break these terms or if your use harms the app or other stores. We can also stop offering the app. If we stop offering the app, we tell you at least 30 days before.
Changes to these terms
We can change these terms. We publish the new text on this page and change the date at the top. If a change is important, we tell you by email or in the app before it applies. If you keep using the app after the change applies, you accept the new terms. If you do not agree, uninstall the app.
Governing law
The law of Pakistan applies to these terms. The courts of Pakistan decide disputes about these terms. If the law of your country gives you rights that an agreement cannot take away, you keep these rights.
